We are excited to announce that in addition to our existing practice areas, we are expanding our mediation practice. Now, she is putting her experience to work as she expands her efforts and experience to mediation cases which will help to support our clients during the most difficult times of their lives. Attorney Kepner is a dedicated advocate for clients and will serve as a discovery referee for personal injury cases.

Understanding Mediation

Mediation is a legal alternative to a dispute. Essentially, both parties may elect to have a third party oversee the negotiations in order to avoid the stress and financial strain of an all-out dispute. The third party should be a legal professional with experience handling disputes.

It is important to note that mediation can apply to various circumstances from personal injury claims to business disagreements and employment disputes. Depending on the case, mediation may serve as a level playing field for both parties to come together and reach resolution without taking the matter to court.

Often, mediation saves time and money compared to court cases. However, mediation does require effort and compromise from both parties to be successful. If mediation does not lead to resolution, the matter may be escalated to court. Most businesses and individuals may choose mediation for the added benefit that all records of the settlement will be kept private. Court cases are a matter of public record and could be damaging to one or both parties depending on the specific circumstances surrounding the case so it is usually wise to seek out more confidential solutions.

Why You Need an Attorney

The process of mediation is more than just a sit down meeting between two parties. In some cases, one or both of the parties involved may represent thousands of people or even the public’s interests. It is crucial that anyone facing a dispute choose an attorney.

A lawyer can help their client decide if mediation is in their best interest. If mediation is the better option, an attorney can provide objective input on the situation and help both parties work toward a mutually beneficial settlement. Only those with mediation experience should be considered for representation.
